ACTIVE PLANET LTD. TOURS TERMS AND CONDITIONS
Currency:
All prices are quoted in New Zealand Dollars (NZD) and include New Zealand Goods and Service Tax (GST) of 15%.
Deposit:
To secure your booking we require a 25% deposit. Payments can be made by credit card (note a 3% surcharge applies), or into the company account via direct money transfer, or international money order or transfer. A receipt will be issued upon payments received. Failure to pay the deposit may result in your tour arrangements being cancelled.
Confirmation in writing:
A booking is only confirmed if we have received the Deposit or confirmation of the customer.
If the customer is underage we require an email or letter from the natural parents, stating that they are informed and agree with the travel plans of their children.
Payments:
Balance of Full payment is required 10 working days before the start of your tour. Bookings made within the last 10 days before the commencement of the Tour are to be paid in full.
We charge a Fee of $20,00 NZ Dollars for overseas transactions.
Cancellation by Active Planet Ltd.:
Should the Tour be cancelled by Active Planet Ltd. due to no fault of the client, the customer will be fully reimbursed within 3 working days.
Cancellation by Customer:
All cancellations must be received in writing and are subject to a cancellation fee. The tour will be refunded if cancelled no less than 15 working days prior to the beginning of the tour.
If the customer cancels between 15 and 10 working days prior to the beginning of the tour we refund 75% of the total price. If the customer cancels the tour less than 10 working days before the start of the tour we refund 50% of the price for the tour.
No refund will be given for No Shows or if the customer does not show up.
Refunds:
Will not be made in cases where clients miss any part of the tour (including sightseeing), do not use accommodation without notifying Active Planet or leave the tour after it has started. Or Where we have booked flights for you as per your request.
Passport:
All travelers must have a valid passport. We can provide assistance with obtaining travel permits where necessary. This service must be requested and may carry an additional charge. .
Flights:
Active Planet will try to book the best available fares. A service Charge for Flight bookings applies. Flights will only be booked if we have at least a Deposit for the flight in the account and if we have the consent of the parents provided the customer is under age.
Health:
Please provide us with the necessary information if we need to know about any relevant health issues. The company reserves the right to send people home if we did not know about a substantial health issue and if we are under the impression that the group is affected or we see a serious risk for the person affected.
Changes to itinerary:
If sudden and unforeseeable circumstances beyond our control force us to make changes to your itinerary, we reserve the right to amend schedules with no additional charge or refund to the client. Active Planet reserves the right to make adjustments to the tour schedule due to weather changes, transport issues or lack of accommodation. This will be compensated with an alternative program if need be.
Price exclusions:
Transport - including flights to and from the start of any tour.(Unless requested by the client and added to the individual travel package)Personally incurred expenses such as additional meals, beverages, optional activities, souvenirs, telephone and laundry charges.
Travel Insurance:
Active Planet Ltd. recommends a comprehensive Travel Insurance Policy at the time of booking, which should cover Medial Expenses, Loss of Baggage, Cancellation Fees, etc. We can advice and assist you with this. Active Planet Ltd. or Contractor¡¯s of the company have Public Liability Insurance.
Law:
The law of New Zealand applies to contracts and disputes. The staff and management of Active Planet Ltd take all practicable steps to identify and minimize potential dangers. However Active Planet Ltd will not accept any liability for accident or injury to you or anyone else arising from your failure to follow our instructions or loss of personal belongings. To the extent permitted by law, all our liability for damage to your property, disruption to travel plans or mental injury is excluded. This exclusion is subject to any rights or remedies you may have under the Consumer Guarantees Act 1993
International Students and U18:
No cases of buying or drinking of alcohol or smoking of illegal drugs or inhalations of any chemical substances will be tolerated on any tours operated by Active Planet Ltd. Active Planet reserves the right to contact legal guardians and/or agents of any participants - who due to their actions continuously cause problems and disruptions that may endanger health, safety or welfare of themselves or other passengers - to either resolve these issues or remove from the tour in a safe and organized fashion. In such cases no refunds will be paid and expenditures for any such arrangements will be solely at the cost of the passenger. Active Planet Ltd agrees to abide by the Code of Practice for the Pastoral Care of International Students when running tours for international students.
We expect that everyone fits into the team and gives us a helping hand to keep the bus clean and assists in the kitchen or whereever else it is required.
Risks:
Activity operators have an element of risk. We won't run an activity if we regard the conditions (weather, flooded rivers, etc.) as too dangerous. The company is not liable for any event or change of itinerary that is beyond our control, including severe weather conditions, nature disasters, industrial action, etc. We do not accept liability for failure on the part of subcontractors. Liabilities of air carriers and other principals and other principals are limited as specified in their tickets, conditions of contract and/or carriage & tariffs. While we take all reasonable care in selecting operators which services are included in your tour, e.g. Hotels, Airlines, and optional activities we cannot accept responsibility for those operators conduct or the conduct of their employees.
